Shimla, February 29: Himachal Pradesh Assembly Secretariat has declared 6 posts of MLAs vacant in 6 assembly constituencies. In this regard, the Assembly Secretary has issued a notification regarding vacant posts of MLAs in Dharamshala, Lahaul-Spiti, Sujanpur, Badsar, Gagret and Kutlehad assembly constituencies. On Thursday morning, the Assembly Speaker had announced the disqualification of the MLAs in a press conference.

The Secretariat of the Assembly has also provided information about the vacant posts to the Secretary of the Election Commission of India.

The big question that arises is whether by-elections will be held in the 6 assembly constituencies of the state along with the Lok Sabha or not. This will depend on whether the disqualified MLAs challenge the order of the Assembly Speaker in the High Court. The disqualified MLAs also have the option of going to the Supreme Court in case they do not get relief from the High Court.

Let us tell you that according to the rules, the assembly seat cannot be kept vacant for more than 6 months. At present the number of MLAs in the 14th Assembly is 62. In this, 34 MLAs are from Congress, 25 from BJP and three are independent. If the independent MLAs remain with the BJP, the opposition’s figure will be 28. Since the number of MLAs in the House has come down to 62, the magic figure of majority is 32.
