Himachal Pradesh Judicial Officer Challenges Supreme Court Collegium’s High Court Judge Recommendations

The petition was mentioned before a Bench comprising Chief Justice of India Surya Kant and Justice V Mohana on Wednesday, seeking an urgent hearing. Representing the petitioner, the counsel argued that the Supreme Court Collegium had recommended the names of judicial officers who were junior to the petitioner, despite his own claim based on seniority and merit.
Responding to the request, Chief Justice Surya Kant stated that he would examine the matter.
Why Has the HP Judicial Officer Challenged the Collegium Recommendation?
The controversy emerged after the Supreme Court Collegium, headed by CJI Surya Kant, on June 2 recommended three judicial officers for appointment as judges of the Himachal Pradesh High Court.
The officers recommended for elevation include Chirag Bhanu Singh, Bhupesh Sharma, and Yogesh Jaswal. Their appointments are currently awaiting approval and official notification from the Department of Justice under the Central Government.
If these appointments receive the final approval, the strength of judges in the Himachal Pradesh High Court will increase from 12 to 15, against the sanctioned strength of 17 judges, including the Chief Justice.
Similar Seniority Dispute Had Reached Supreme Court Earlier
This is not the first time concerns regarding seniority and merit in judicial appointments from Himachal Pradesh have reached the Supreme Court.
In 2024, two district judges had also approached the apex court, claiming that the Himachal Pradesh High Court Collegium overlooked their seniority and merit while recommending names for elevation as High Court judges.
Taking note of the issue, the Supreme Court in September 2024 asked the Chief Justice of the Himachal Pradesh High Court to reconsider their cases.

The latest plea once again highlights the ongoing debate surrounding transparency, seniority, and merit in the process of appointing judges to higher courts. The Supreme Court’s decision on the judicial officer’s challenge could have an impact on how such disputes related to judicial elevation are addressed in the future.
