Advocate Karuna Nundy : No civil justice in Bhopal Gas Tragedy Case –Diarytimes
The Supreme Court has dismissed the curative petition of the Centre. That is, the victims of the 1984 Bhopal gas tragedy will not get increased compensation. Court reserved verdict on 13-year-old petition in January.
The Supreme Court has dismissed the curative petition of the Centre, in which the Center had demanded additional compensation from Dow Chemicals regarding the Bhopal gas tragedy. Due to this, along with the gas victims, the central and state government has also got a big blow. The Supreme Court had completed the hearing on the curative petition filed in 2010 in January. The verdict was reserved and the verdict was pronounced on Tuesday.
In its petition, the central government had said that in 1989, when the Supreme Court fixed the compensation, 2.05 lakh victims were taken into account. In these years, the number of gas victims has increased more than two and a half times to more than 5.74 lakhs. In such a situation, the damages should also increase. If the Supreme Court had agreed to increase the compensation, lakhs of gas victims of Bhopal would have also benefited from it. However, the court rejected these arguments and made it clear that the one-time deal with Union Carbide’s parent company Dow Chemicals in 1989 cannot be reopened.
