Palampur businessman Nishant Kumar Sharma had filed a complaint in the Himachal Pradesh High Court alleging threat to the life of himself and his family from his partners.

The appeal has been filed by advocate Gaurav Gupta and the appeal is yet to be listed for hearing.

Learn about the case in detail –

On January 9, in a blow to Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri, the Himachal Pradesh High Court had rejected their plea for withdrawal of its order on December 26, 2023.

In the petition, transfer of Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri was ordered so that they do not affect the investigation process in the entire case.

The Himachal Pradesh High Court had also rejected the requests of both the officers for a CBI investigation, And instructions were issued to the Government of Himachal Pradesh to constitute a Special Investigation Team (SIT) consisting of Inspector General level officers of Himachal Pradesh Police to coordinate the investigation in all FIRs within the next two weeks.

Disapproving of the conduct of both the top officials, the Himachal Pradesh High Court had said that “DGP Dr Sanjay Kundu’s attempt to resolve the entire dispute prima facie appears to be a colorful exercise of his power and authority”.

The judgment also said that it was highly inappropriate for Himachal Pradesh DGP Dr. Sanjay Kundu to intervene in a minor civil dispute.

It was also found that prima facie there was dereliction of duty on the part of Kangra District Police Administration SP Shalini Agnihotri.

Let us tell you that that important order was stayed by the Supreme Court of India on January 3. In which the Himachal Pradesh Government had issued a notification to remove DGP Dr. Sanjay Kundu from the post of DGP and was also asked to file an application to summon DGP Dr. Sanjay Kundu before the Himachal Pradesh High Court.
