Shimla, March 29: In a significant move to tackle the rising menace of organized crime in Himachal Pradesh, the state government has passed the Himachal Pradesh Organized Crime Bill in the assembly. Introduced by Chief Minister Sukhvinder Singh Sukhu on Friday, the bill outlines strict punishments, including life imprisonment or even the death penalty, for those involved in severe criminal activities such as drug smuggling, illegal mining, human organ trafficking, and more.
The new law, which will now be sent to the Governor for approval, aims to address the growing concerns over organized criminal activities that have been undermining the safety and security of citizens. It sets stringent provisions for the perpetrators and conspirators involved in a wide range of illegal activities that threaten the social fabric and economy of the state.
Harsh Penalties for Severe Offenses
The bill stipulates that individuals involved in organized crime, including drug smuggling, illegal mining, human organ trafficking, dumping of hazardous substances, and adulteration of food items, could face life imprisonment or even the death penalty. This provision targets the most dangerous criminal operations that have been harming public health, safety, and the environment.
In addition to imprisonment, offenders could face hefty fines, with penalties reaching up to Rs 10 lakh. The law also includes a provision to confiscate the property obtained through illegal activities, particularly focusing on assets acquired from drug smuggling.
Punishment for Conspirators and Gang Members
The bill is also tough on those who instigate, conspire, or assist in the commission of organized crimes. Individuals found guilty of such acts will face a minimum sentence of one year in prison along with a fine of up to Rs 5 lakh.
For members of organized crime gangs, the law mandates a minimum sentence of one year and the possibility of a life sentence. Those found aiding criminals, including by providing shelter or hiding criminals, will face six months to one year in prison, and be fined between Rs 20,000 to Rs 5 lakh.
Moreover, individuals involved in taking commissions from organized crimes will face up to one year of imprisonment and a fine up to Rs 2 lakh. The law thus targets not only the perpetrators but also those who profit from criminal activities.
Strict Actions Against Drug Trade
A major focus of the bill is on the drug trade, which has plagued several parts of the state. The bill proposes a severe punishment of 2 to 14 years of imprisonment for anyone found involved in the production, sale, purchase, or transportation of narcotics. In addition, a fine ranging from Rs 20,000 to Rs 10 lakh will be imposed.
Special emphasis has been laid on government employees found participating in the drug trade. They will face 1.5 times the standard punishment and fine, reflecting the greater responsibility that public servants hold.
Action on Illegal Occupation and Property
The bill also takes a strong stance against individuals involved in illegal occupation of property. If an organized criminal occupies either movable or immovable property and cannot provide a valid explanation for the occupation, they will face up to one year in jail.
