Himachal News: Governor said- Accepting the resignations of independent MLAs is a matter of the jurisdiction of the Assembly Speaker.

Reported & Written By Kumud Sharma, Diary Times, Shimla, March 28: Governor Shiv Pratap Shukla has said that he cannot issue any instructions on the matter of accepting the resignations of three independent MLAs, he can only give advice, as it is a matter under the jurisdiction of the Assembly Speaker. He has also told the three independent MLAs that this is only the jurisdiction of the Assembly Speaker.
While talking to the media on Thursday, the Governor said – The three independents first submitted their resignations to the Assembly Secretary and then to the Speaker personally. The three independents have also given me a copy of the resignation letter that has been given to the Speaker.

That is why I have sent it to the Speaker and have also mentioned the cases of Madhya Pradesh and Karnataka where such decisions have come from the Supreme Court that resignations should be accepted immediately. If the MLAs personally submit their resignations to the Speaker, it should be accepted. Court decisions have been brought to his attention. However, he can only give advice on this subject. They do not have any constitutional rights. If there is dissatisfaction with the decision of the Assembly Speaker then they can go to court. He is satisfied that the Speaker has also sent him a reply, in which he has said some things. But looking at the court’s decisions, he believes that these resignations should be accepted.
