Himachal Pradesh High Court : The Home Department of the Himachal Pradesh Government had challenged the Himachal Pradesh High Court on Saturday demanding the Himachal Pradesh High Court to reserve 65 to 70 cases, but the hearing was postponed due to paucity of time.

The ruling Sukhu government of Himachal Pradesh has challenged in the Himachal Pradesh High Court under the Home Department to quash the criminal cases filed by the public against 30 MLAs and other former MLAs of all parties with different criminal records. A hearing petition was filed before the Himachal Pradesh High Court to dismiss with immediate effect about 65 to 70 cases that maligned the image of the MLAs, but the hearing of the case listed in the Himachal Pradesh High Court was to be held in the Shimla bench on Saturday. Due to lack of time, this hearing could not be held and it was transferred to the special court for hearing.

In the application, Himachal Pradesh Home Department has clearly stated that these cases are pending in the Lok Adalats of various 12 districts of Himachal Pradesh for a long time.

The Home Department of Himachal Pradesh Government clearly told the Himachal Pradesh High Court that due to the instructions of political and social workers, all these criminal cases have been registered in the police stations of various districts against the present and former 30 MLAs of all the districts. The Home Department of the Government of Himachal Pradesh has clearly stated to the Himachal Pradesh High Court that none of the cases registered against all the 30 MLAs are serious and recommend IPC sections, and also the Home Department of the Government of Himachal Pradesh has clearly stated that That all these criminal cases involving law enforcement and their confirmations are not being misrepresented and that no unrelated things have been presented in the cases against all these MLAs.

The Home Department of Himachal Pradesh Government clearly presented before the Chief Justice of Himachal Pradesh High Court and said that all the petitions filed are being heard with full confidence in all personal policies, legal and judicial system. The rule of law has not been violated, and the petition has been presented before the judge keeping all constitutional interests in mind.

What does the judicial system say in criminal cases?

According to the new order of the Supreme Court on the judicial petition of the Home Department of Himachal Pradesh Government, additional judges have been appointed in the High Courts of all the states specifically to deal with any kind of criminal cases registered against the MLAs and MPs and till now additional judges have been appointed. The judges have given their consent only on seven cases in their proceedings.

There was a consensus in the Supreme Court on this matter

While reserving its decision, the Supreme Court, while hearing the petitions of Ashwini Kumar Upadhyay and the Government of India, had said that the process of appointment of additional judges will be started to dispose of the criminal cases of all former MLAs and MPs.

Keeping these rules in mind, Himachal Pradesh High Court has given its consent to the criminal proceedings of all the MLAs and MPs by starting the process of appointment of additional judges in special courts.

Will be settled as soon as possible

Himachal Pradesh High Court has issued orders to the special courts to immediately dispose of the cases against Himachal Pradesh MLAs and MPs in all criminal cases.

In the petition filed by the Home Department of Himachal Pradesh Government, three criminal cases have been registered against Himachal Pradesh Chief Minister Sukhwinder Singh Sukhu and PWD Minister Vikramaditya Singh, two criminal cases against Anirudh Singh and Vikram Jaryal, six criminal cases against Kuldeep Singh Rathore and six criminal cases against Rakesh Singha. 25 criminal cases have been registered and four criminal cases have been registered against Bhuvaneshwar Gaur.
