REASONS
In recent years various concern has been shown by authorities all over the country related to the online sale of drugs. The concern is related to misuse, quality of drugs, and self-medication. This online sale of drugs may have some benefits but, the drawbacks are many.
- There are chances of misuse of various drugs that are not allowed to be sold without a prescription.
- There are chances of poor quality medicine being available for sale.
- Chances of selling expired medicines.
- There is a huge threat of self-use with can be very harmful to any individual without appropriate knowledge.
All these are the reason for concern, that was, presented in the Delhi High Court.
TRESPASSING RULES
Various laws were made related to drug sale has been trespassed.
- According to the Drugs and Cosmetic Act, of 1940, provisions for a certain category of high drugs are not allowed to be sold without a prescription from a registered pharmacist.
- According to section 18 (c), the sale, stocking, and distribution of drugs are only allowed to licensed pharmacies.
- Rule 64 of the Drugs and Cosmetic Acts, that a prescription is necessary before the sale of medicine.
Many of these rules have been trespassed by various online selling platforms.
RESULT
Thus, there were many cases in various courts of the country asking prohibition of the online sale of drugs. This made the honorable High Court of Delhi pass an order on 12.12.2018 in the matter of Dr. Zaheer Ahmed vs Union of India and others, setting a prohibition on the online sale of drugs. The order has been forwarded to all the states and union territories on 08.05.2019, 28.11.2019, and 03.02.2023 to take necessary action on it.
Ministry of Health has given show cause notice to almost two dozen companies including Practo, Amazon, Flipkart, Tata 1mg, Netmeds, Apollo, Zeelabs, and many more. All the companies are notified to respond within 2 days to the Central Drugs Standard Control Organisation. In case of no response, strict action will be taken against the company.
