HP High Court Orders Attachment of Himachal Bhawan, New Delhi, to Enforce Arbitration Award Compliance

Shimla, November 19: The Himachal Pradesh High Court has issued orders to attach Himachal Bhawan, 27-Sikandra Road, Mandi House, New Delhi to ensure compliance with the Arbitration Award. High Court Judge Ajay Mohan Goyal gave this order after hearing the compliance petition filed by Seli Hydro Electric Power Company Limited against the Energy Department.

The court also ordered the Principal Secretary of MPP and Power Department to conduct a factual inquiry as to due to the negligence of which particular officer or officers the award amount of Rs 64 crore along with seven percent interest has not been deposited in the court. The court said that it is necessary to find out the culprits because the interest will be ordered to be recovered personally from the guilty officers and employees.

The court also ordered to complete the investigation within a period of 15 days and present the report of the investigation before the court on the next date. The hearing on the case will be held on December 6. After this, the state BJP has again attacked the government. Leader of Opposition Jai Ram Thakur said that Himachal Bhawan, which is called a symbol of Himachal’s honor, has been ordered to be confiscated today. What can be more shameful for the state than this. The Chief Minister and his government have torn the honor of the state to shreds, Himachal is standing on the threshold of auction today.

At the same time, BJP State President Dr. Rajiv Bindal said that the High Court has questioned the state government. The government has failed everywhere. It is not able to present its side in the court. This is the reason why orders have been given to attach Himachal Bhawan to Delhi.

Let us tell you that in the year 2009, the government had allotted a 320 MW power project to the company. This project was to be set up in Lahaul-Spiti. At that time, the government had given the work of road construction to BRO to set up the project. According to the agreement, the government had to provide basic facilities to the company, so that the company could start the work of the project on time. The company filed a writ petition in the High Court in the year 2017.
