Shimla: In an important decision, the Himachal Pradesh High Court has banned outsourced recruitment through Electronics Corporation. In this decision, concern has been raised over the integrity of this process. A division bench of Acting Chief Justice Tarlok Singh Chauhan and Justice Satyen Vaidya has directed that outsourced recruitment will not be allowed until the data of all the companies registered under the corporation is uploaded on its official website.
This step has been taken after allegations that many companies involved in the recruitment process are fake. The counsel for the petitioner told the court that 110 such companies have been identified as fake, yet thousands of people are being recruited through them, putting the future of the youth of the state at risk.
The court expressed serious concern over the recruitment processes and said that outsourced employees are often kept for years despite the short-term nature of their contract and are paid less for more work. The petitioner has also sought the formation of a Special Investigation Team (SIT) to probe the fake companies. He has suggested that the probe should be conducted under the supervision of a retired High Court judge.
The court has asked the state government to file a detailed status report on the matter. The next hearing will be held on November 21.
In its direction, the court emphasised that the ongoing recruitment for outsourced posts advertised under the Recruitment and Promotion (R&P) Rules undermines the regular recruitment process and poses a serious risk to fair treatment of employees. The government has been asked to ensure complete transparency by making company data available online. Failing to do so, the ban on outsourced recruitment will remain in effect.
This decision is a big step towards eliminating exploitation of outsourced employees and conducting recruitment processes in the state in a fair and transparent manner.
