Himachal: Now those who serve on contract will also get pension benefits, order issued by Himachal government

Reported & Written By Kumud Sharma, Diary Times, Shimla, June 10 :There is a great update for all the government employees of Himachal Pradesh.Now the contract service period of all the government employees of Himachal Pradesh is also going to be counted in the pension.Due to which the Himachal Pradesh government will now give pension to thousands of retired employees, whose pension was canceled because they had worked for a long time in the contract period during their service period.

The Himachal Pradesh government has suffered a setback in the case of Sheela Devi vs Himachal Pradesh Government for not counting the contract service period of government employees in the pension, due to which orders have been issued by the office to implement the judgment of the Supreme Court by the Himachal Pradesh government.

According to the office order of the Himachal Pradesh government, one month’s time has been issued to all the eligible employees and pensioners of pension to give their option.

Along with this, the Supreme Court has recently given an important decision in the case of Sheela Devi vs. Himachal Pradesh Government and said that the service given as a contract employee should also be counted for pension under all circumstances.

The Supreme Court has given clear orders to the Himachal Pradesh government that all the employees who have been regularized in the job should be given an opportunity to choose an option according to the rules for contract employees.

The Supreme Court has ordered the Himachal Pradesh government to take necessary steps to make rules to provide an opportunity to exercise the option within a stipulated time period to all regularized contract employees, whether they were regularized before 2003 or after, with immediate effect.

After the order of the Supreme Court, orders have been issued by the office of the Himachal Pradesh government to the employees to choose the option.The Himachal Pradesh government has asked to give the option to such employees to count their contract period in the pension.Government employees will have to contact their department head to give this option, And if he does not do so, he will not be given pension for the contract service period.

It is worth noting that in the year 2019, after hearing the petition filed by the widow of Ayurvedic doctor Sheela Devi for family pension, the Himachal Pradesh High Court had ordered the contract service to be counted for pension.According to the evidence filed in the petition, the applicant’s husband was appointed on contract basis to the post of Ayurvedic doctor in the year 1999. His services were regularized in the year 2009.On 23 January 2011, the husband of the applicant Sheela Devi died. An application for pension was given by the applicant to the Himachal Pradesh government, which was rejected by the state government by stating that the applicant’s husband was appointed on contract basis and the services given on contract basis are not considered for pension.After observing the decisions given by the Himachal Pradesh High Court in various cases, the division bench found that the case filed for granting pension to the applicant is justified.

The Himachal Pradesh High Court had also said that the applicant’s husband has benefited the state government by serving on a contract basis at a low salary, And not counting the contract services in the pension shows the wrong behavior of the state government, which the law does not allow at all.
