The merits of the petitions challenging the appointments of the CPS were raised by the Himachal Pradesh state government.
A special argument was given by the Himachal Pradesh Government that all the important petitions have not been filed as per the rules of the Himachal Pradesh High Court.
Himachal Pradesh High Court has rejected the application made by Himachal Pradesh Government in the matter of appointments of all CPS including Deputy Chief Minister.
Questions were consistently raised over the merits of the petitions filed by the Himachal Pradesh State Government challenging the appointments of all CPSOs.
In this case, it was argued by the Himachal Pradesh Government that all the petitions have not been filed as per the rules of the Himachal Pradesh High Court.
The petitioner had challenged all the appointments of the MLA from Una district of Himachal Pradesh through three petitions. In the Himachal Pradesh High Court, for the first time in 2016, the People for Responsible Governance organization challenged the CPS petition in the Himachal Pradesh High Court.
An application was filed on behalf of the petitioner to make the CPS a respondent after the new ruling Congress government of Himachal Pradesh appointed the CPS as a respondent.
Due to which, Kalpana Devi, a resident of Mandi district of Himachal Pradesh, had also filed a petition regarding the appointments of all the CPS.
In Himachal Pradesh High Court, BJP leader Satpal Satti had challenged the petition of CPS along with the Deputy Chief Minister.
The Himachal Pradesh High Court court is also hearing all the petitions simultaneously.
Himachal Pradesh as CPS Sanjay Awasthi from Arki Assembly Constituency, Sundar Singh Thakur from Kullu Assembly Constituency, Ram Kumar from Doon Assembly Constituency, Mohan Lal Brakta from Rohru Assembly Constituency, Ashish Butail from Palampur Assembly Constituency and Kishori Lal from Baijnath Assembly Constituency. In 2017, the CPS petition was challenged in the Himachal Pradesh High Court.
In all the important petitions of Himachal Pradesh High Court, the petitioner has alleged that similar appointments of CPS were made in Punjab also, which was challenged before the Punjab and Haryana High Court.
All these appointments were held unconstitutional by the Himachal Pradesh High Court.
