High Court dismisses Harsh Mahajan’s petition, orders to file reply within two weeks

In the much discussed Rajya Sabha election case in Himachal Pradesh, the High Court on Monday gave a big blow to Rajya Sabha MP Harsh Mahajan. The court rejected the application filed by Rajya Sabha MP Harsh Mahajan, in which he had demanded not to accept the petition filed by Abhishek Manu Singhvi. The court has given this order on Abhishek Manu Singhvi’s petition challenging the election process.

Shimla, September 16: In the much discussed Rajya Sabha election case in Himachal Pradesh, the High Court on Monday gave a big blow to Rajya Sabha MP Harsh Mahajan. The court rejected the application filed by Rajya Sabha MP Harsh Mahajan, in which he had demanded not to accept the petition filed by Abhishek Manu Singhvi. The court has given this order on Abhishek Manu Singhvi’s petition challenging the election process.

Harsh Mahajan’s advocate Vikrant Thakur in Himachal Pradesh High Court said that Mahajan had filed a petition in the court and requested that Abhishek Manu Singhvi’s petition is unacceptable. However, the court did not accept this petition and has issued an order to file a reply within two weeks.

It is worth noting that Rajya Sabha elections were held in Himachal Pradesh on 27 February. Despite the Congress having a huge majority, BJP candidate Harsh Mahajan won the election. There were 40 Congress MLAs and 25 BJP MLAs in the assembly, while three independent MLAs were supporting the government. Despite this, in the Rajya Sabha elections, 6 Congress and 3 independent MLAs voted against the Congress candidate, resulting in both candidates getting 34-34 votes.

The Election Commission adopted the slip process, in which BJP candidate Harsh Mahajan won. This slip system has been challenged in the High Court by Abhishek Manu Singhvi. The hearing on which will now be held after two weeks.
