The Himachal Pradesh High Court has stayed a state government clarification allowing MLAs to vote in municipal president and vice-president elections. The case will be heard again on June 17.

Shimla, June 6: In a significant development that could influence local governance across Himachal Pradesh, the Himachal Pradesh High Court has temporarily barred Members of the Legislative Assembly (MLAs) from participating in elections for the posts of president and vice-president in municipal councils and nagar panchayats.

The interim order was passed by a Division Bench comprising Justice Vivek Singh Thakur and Justice Ranjan Sharma while hearing a group of petitions challenging the state government’s interpretation of urban local body laws.

What Led to the Court’s Decision?

The controversy arose after the Himachal Pradesh government issued a clarification permitting local MLAs to vote during the election of presidents and vice-presidents of municipal councils and nagar panchayats.

However, several elected municipal councillors approached the High Court, arguing that the clarification went beyond the powers granted under existing laws. According to the petitioners, MLAs may attend meetings and vote on resolutions of municipal bodies, but they do not have a legal right to participate in elections meant exclusively for elected councillors.

The petitioners maintained that the authority to elect municipal presidents and vice-presidents belongs solely to elected councillors, who directly represent local voters.

Court Grants Interim Relief

After hearing the arguments, the High Court found sufficient grounds to consider the petitioners’ concerns and issued an interim stay on the government’s clarification.

As a result, until further orders are issued by the court, MLAs will not be allowed to participate in or cast votes during elections for the posts of president and vice-president in municipal councils and nagar panchayats across Himachal Pradesh.

Impact on Urban Local Body Elections

The court’s order is expected to have a major impact on the ongoing process of electing leadership in urban local bodies throughout the state.

Political observers believe the decision could alter the balance of power in several municipal bodies where the participation of MLAs might have influenced election outcomes. The ruling also reinforces the importance of elected councillors in determining local leadership.

Next Hearing Scheduled for June 17

The matter is now scheduled for further hearing on June 17, when the High Court will examine the legal validity of the state government’s clarification in greater detail.

Until a final verdict is delivered, municipal elections for president and vice-president posts will proceed without the involvement of MLAs, ensuring that only elected councillors participate in the voting process.
