The controversy erupted after the activists allegedly staged a protest during the AI Summit in New Delhi. According to BJP leaders, when the Delhi Police arrived in Himachal to execute transit remand orders and detain the accused, they were stopped — triggering an unprecedented confrontation between police forces of two states.
BJP Submits Memorandum to Governor
A BJP delegation led by Leader of Opposition Jai Ram Thakur, along with Nachan MLA Vinod Kumar and Chopal MLA Balbir Verma, submitted a memorandum to the Governor expressing “serious concern” over the incident.
Speaking to reporters, Jai Ram Thakur said he was “shocked” that in a federal structure, established norms were allegedly disregarded. He claimed that despite obtaining transit remand from a competent court, the Delhi Police team was obstructed from carrying out its duty.
“This is the first-ever incident in Himachal where due process was flouted to allegedly provide political protection to individuals wanted by the police,” Thakur said, calling the episode deeply concerning for democratic governance.
Demand for Independent and Central Agency Probe
The BJP has urged the Governor to order:
- An independent inquiry into the role of the Chief Minister’s Office (CMO)
- A high-level probe by a central agency
- Action against any politicians or police officials found responsible
The party alleged that the sequence of events reflects a “misuse of administrative machinery” and claimed that the CMO functioned like a political office rather than a constitutional authority during the episode.
In its memorandum, the BJP stated that attempts were made to obstruct the Delhi Police despite court-sanctioned procedures being in place. The party termed the incident “unfortunate” and warned that such actions could undermine the rule of law.
A Test for Federal Coordination?
The incident has sparked a wider debate about coordination between state police forces and adherence to legal protocols within India’s federal framework. While the ruling dispensation is yet to issue a detailed clarification, the political temperature in Himachal has visibly risen.
As the matter now rests with the Governor’s office, all eyes are on whether an independent or central-level inquiry will be ordered — a move that could further escalate political tensions in the hill state.
