Himachal: After relief from Supreme Court, Kundu appealed to withdraw the decision, hearing on the petition on Friday.
After getting interim relief from the Supreme Court, now an application has been filed by Himachal Pradesh DGP Dr. Sanjay Kundu. Hearing on Dr. Sanjay Kundu’s application will be held on Friday. Kangra District Police Administration SP Shalini Agnihotri has also filed an application demanding withdrawal of the orders given against her.

The matter related to the security arrangements of Palampur businessman Nishant Kumar Sharma and transfer of Himachal Pradesh DGP Dr. Sanjay Kundu was heard in the Himachal Pradesh High Court on Thursday. After getting interim relief from the Supreme Court, Himachal Pradesh DGP Dr. Sanjay Kundu has filed an application seeking withdrawal of the Himachal Pradesh High Court’s decision to transfer him to any other post.

Kangra District Police Administration SP Shalini Agnihotri has also filed an application in the Himachal Pradesh High Court demanding withdrawal of the orders given against her. Hearing process will be held on Friday in Himachal Pradesh High Court on the applications of Himachal Pradesh DGP Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri.
Himachal Pradesh High Court had issued orders on December 26, 2023 last year, removing Himachal Pradesh DGP Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri from their current posts with immediate effect.
The division bench of Himachal Pradesh High Court Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua had issued orders to the Himachal Pradesh Home Secretary to take necessary steps in this regard with immediate effect. Following the order of Himachal Pradesh High Court, DGP Dr. Sanjay Kundu got interim relief from the Supreme Court and obtained a stay order on his transfers. Dr. Sanjay Kundu said that the Himachal Pradesh High Court had issued orders to transfer him without knowing his side. In this regard, the Supreme Court had given permission to Dr. Sanjay Kundu to present his side before the Himachal Pradesh High Court.
It is noteworthy that the Himachal Pradesh High Court, while clarifying the entire reason behind issuing orders for posting of both the top officers of Himachal Pradesh Police on such posts, had said that the entire investigation process should not be affected and proper justice should be seen to be done. Therefore, Both the senior officers of Himachal Pradesh Police should be posted by the Himachal Pradesh Home Department at such places from where they cannot in any way influence the investigation process of the FIRs registered in the entire case.
The case related to the security arrangements of Palampur businessman Nishant Kumar Sharma is being heard in the Himachal Pradesh High Court. In the entire matter, the applicant Nishant Kumar Sharma had also informed the Himachal Pradesh High Court about the threat to the safety of himself and his family through an e-mail.
Converting the e-mail of the applicant Nishant Kumar Sharma into a criminal writ petition, the Himachal Pradesh High Court has passed an interim order directing the Shimla District Police Administration SP and Kangra District Police Administration SP to provide proper security arrangements to the applicant Nishant Kumar Sharma with immediate effect. On behalf of Kangra District Police Administration SP Shalini Agnihotri, it was told that the investigation process of all the allegations made in the FIR registered on the complaint of applicant Nishant Kumar Sharma has been handed over to Kangra District Police Administration Additional SP. Shimla District Police Administration SP had also expressed suspicion of involvement of high profile people in the entire matter.
