Himachal News: Supreme Court stays the decision to transfer Sanjay Kundu from the post of DGP
The Supreme Court of India has stayed with immediate effect the twenty-sixth December order of the Himachal Pradesh High Court transferring Himachal Pradesh Director General of Police Dr. Sanjay Kundu to another post.
The Supreme Court of India on Wednesday put on hold with immediate effect an important order of the Himachal Pradesh High Court, in which the Himachal Pradesh government was directed to appoint senior IPS officer Dr. Sanjay Kundu as the next Director General of Himachal Pradesh Police (DGP). Orders were issued to transfer him from important posts.
According to Indian news agency PTI, a bench headed by Supreme Court Chief Justice Divya Chandrachud has granted liberty to Himachal Pradesh DGP Dr. Sanjay Kundu to approach the Himachal Pradesh High Court to withdraw the order of December 26.
Justice JB Pardiwala and Justice Manoj Mishra have also been included in the Supreme Court bench. The Supreme Court bench has said that until the recall application is disposed of by the Himachal Pradesh High Court, the direction for transfer of Dr. Sanjay Kundu from the post of Director General of Police of Himachal Pradesh will remain on hold. The Supreme Court has requested the Himachal Pradesh High Court to dispose of the recall application within the next two weeks.

On Tuesday, the Supreme Court had agreed to hear a petition filed by senior IPS officer Dr. Sanjay Kundu. In the petition filed on behalf of Dr. Sanjay Kundu, following the order of Himachal Pradesh High Court, his removal from the post of DGP of Himachal Pradesh was challenged. The petition alleged that they had tried to put pressure on a businessman, who claimed that he was under constant threat to his life from his partners.
Senior IPS officer Dr Sanjay Kundu’s lawyer had told the Supreme Court that the case was completely extraordinary as the officer was not heard before the Himachal Pradesh High Court directed the Himachal Pradesh government to transfer Dr Sanjay Kundu. Following the instructions of the Himachal Pradesh High Court, the order to transfer Dr. Sanjay Kundu was issued by the Himachal Pradesh government on Tuesday. Dr. Sanjay Kundu was transferred as Principal Secretary, Department of AYUSH, Himachal Pradesh.

The Himachal Pradesh High Court had directed the Himachal Pradesh government to transfer the Himachal Pradesh Police Chief and Kangra Superintendent of Police so that they do not in any way influence the investigation into the complaint of threat to the life of a businessman.
Let us tell you that after the decision of Himachal Pradesh High Court, Himachal Pradesh Government on Tuesday removed Dr. Sanjay Kundu from the post of DGP and promoted him to the post of Principal Secretary in Himachal Pradesh AYUSH Department. Along with this, the Himachal Pradesh Home Department had also given additional charge of Himachal Pradesh DGP to ADGP CID Satwant Atwal Trivedi late on Tuesday night. Himachal Pradesh DGP Dr Sanjay Kundu had gone to the Supreme Court against the decision of the Himachal Pradesh High Court. Now the Supreme Court has given its verdict in favor of DGP Dr. Sanjay Kundu.
