In a significant relief for Congress leader Thakur Singh Bharmouri, the High Court has quashed an FIR filed against him over alleged derogatory remarks made during an election speech.

The decision came from Justice Sandeep Sharma, who observed that continuing the case would only lead to unnecessary harassment and a prolonged legal battle, with little chance of conviction.

📌 What Was the Case About?

The matter dates back to October 3, 2021, when a complaint was filed by Surender Singh, a resident of Theog. He alleged that Bharmouri had used objectionable language against the Prime Minister during an election rally.

The complaint, initially sent via email to the Chief Electoral Officer in Shimla, was later forwarded to the Bharmour police station in Chamba district. This led to the registration of an FIR under provisions of the Representation of the People Act, 1951, along with sections of the Indian Penal Code, including those related to promoting enmity during elections and intentional insult.

⚖️ What Did the Court Say?

After carefully reviewing the case records, the court found major gaps in the allegations.

  • There were no specific details of the alleged derogatory remarks.
  • No credible evidence was presented to prove intent to insult or provoke unrest.
  • There was no indication of any disturbance to public peace caused by the speech.

Justice Sharma clearly stated that simply accusing someone of making inappropriate or exaggerated political remarks is not enough to invoke criminal charges—especially without solid proof.

💬 Why This Matters

Political speeches often involve strong language, especially during election campaigns. However, this judgment reinforces an important legal principle: allegations alone are not enough—evidence is crucial.

The court emphasized that without clear proof of intent and impact, such cases should not proceed, as they risk misusing legal provisions and burdening individuals with unnecessary trials.
