State Cadre Status Granted to Constables in Himachal, Transfers Now Possible Across Districts

Marking a significant development in the history of the Himachal Pradesh Police Service, the state government has officially implemented the Himachal Pradesh Police (Amendment) Act, 2024. The Act has been notified by the Law Department and published in the official gazette.

Under this new provision, all Grade-II police personnel—namely constables and head constables—will now fall under the state cadre, rather than being confined to district-level postings as before.

This shift will directly impact thousands of police personnel across the state, allowing their transfers to be made to any district within Himachal Pradesh. Previously, the district cadre system limited officers’ postings to a single district, often resulting in long tenures in the same police station, which in turn raised concerns about transparency and operational impartiality. The new system is expected to improve efficiency, reduce administrative bias, and address public grievances more effectively.

Key Provision on Arrest of Public Servants

The amended Act also introduces a crucial clause concerning the arrest of public servants. Going forward, no police officer may arrest a government employee for actions undertaken in the course of their official duties without prior approval from the state government. This safeguard has been put in place to prevent disruptions to government functioning and protect officers performing their lawful duties.

It is noteworthy that the amended legislation was passed during the winter session of the State Assembly held at Tapovan, Dharamshala, earlier this year. Following its passage, it was forwarded to Governor Shiv Pratap Shukla and subsequently sent to the President of India for approval. With presidential assent now received, the bill has officially become law.
