Himachal Pradesh Government has cancelled the transfer order of Director General of Police Sanjay Kundu to the post of Principal Secretary AYUSH with immediate effect.
After the decision of the Supreme Court of India, the transfer order of DGP Dr. Sanjay Kundu has been withdrawn.
DGP Sanjay Kundu is now going to continue on the post of Himachal DGP.
Notification has been issued by the Himachal Pradesh government regarding the continuation of DGP Dr. Sanjay Kundu.
Let us tell you, on January 12, the Himachal Pradesh High Court’s order to transfer IPS officer Sanjay Kundu from the post of Himachal Pradesh Director General of Police (DGP) was set aside by the Supreme Court of India with immediate effect.
Himachal Pradesh High Court had issued an order to Himachal Pradesh Home Department to transfer IPS officer Dr. Sanjay Kundu from the post of DGP with immediate effect on the allegations of interference in the impartial investigation of the entire case of Palampur businessman Nishant Kumar Sharma.
Know the entire case of DGP Dr. Sanjay Kundu –
Last year in 2023, on December 26, the Himachal Pradesh High Court issued this order in the suo motu proceedings initiated on the letter petition sent by Palampur businessman Nishant Kumar Sharma to IPS officer Dr. Sanjay Kundu and a lawyer expressing apprehension of threat to his life.
Complainant Palampur businessman Nishant Kumar Sharma had alleged that petitioner DGP Dr Sanjay Kundu was interfering in the entire investigation.
Considering it necessary to ensure impartial investigation of the entire matter, Himachal Pradesh High Court had issued transfer order of DGP Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri to Himachal Pradesh Home Department.
On January 3, the Supreme Court of India had stayed that order of the Himachal Pradesh High Court and given liberty to IPS officer Dr. Sanjay Kundu to approach the Himachal Pradesh High Court to withdraw the earlier order.
On January 9, the Himachal Pradesh High Court rejected the application of DGP Dr. Sanjay Kundu seeking withdrawal of the entire order and directed the Himachal Pradesh government to constitute a SIT to investigate the complaint of Palampur businessman Nishant Kumar Sharma.
After this, the Supreme Court had rejected the Himachal Pradesh High Court’s direction to transfer DGP Dr. Sanjay Kundu but did not interfere in the direction to transfer the investigation to the SIT.
The Supreme Court has made it clear that the petitioner DGP Dr. Sanjay Kundu is not going to influence in any way the impartial investigation process of the Himachal Pradesh SIT in the entire case.
The Supreme Court has ordered that the petitioner DGP Dr. Sanjay Kundu is not going to exercise any control over the SIT constituted in compliance with the instructions of the Himachal Pradesh High Court.
Now the transfer order of Himachal Pradesh DGP Dr. Sanjay Kundu has been cancelled by the Himachal Pradesh Government with immediate effect.
