SC to take up plea seeking inquiry into killing of Atiq, Ashraf on April 24
The Supreme Court on Tuesday agreed to list on April 24 a plea seeking setting up of an independent expert committee headed by a former Supreme Court judge to probe the murder of Atiq and Ashraf in the presence of the police. Advocate Vishal Tiwari sought urgent hearing of his plea before a bench headed by Chief Justice of India DY Chandrachud. The apex court listed it for April 24.
Advocate Tiwari mentioned this in the Supreme Court during an urgent hearing on a petition seeking constitution of an independent expert committee headed by a former Supreme Court judge. According to Uttar Pradesh’s Special Director General of Police (Law and Order), Advocate Tiwari has moved the Supreme Court seeking constitution of an independent expert committee headed by a former Supreme Court judge to investigate 183 encounters that have taken place since 2017. Filed a petition. ) and also investigate the brazen murder in police custody of gangster-turned-politician Atiq Ahmed and his Ashraf.
Atiq and Ashraf were shot dead on Sunday while being taken to a hospital in Prayagraj under heavy police presence. Advocate Vishal Tiwari in his PIL has sought direction to the Central Bureau of Investigation (CBI) to investigate, collect and record evidence in the Kanpur Bikru Encounter Case 2020 to unearth the fake encounters in which Vikas Dubey and his associates were killed by the police. I was killed because the commission of inquiry could not record evidence to contradict the statement of the police and in the absence of the same filed the inquiry report.
The petition states, “Uttar Pradesh police have tried to be daredevils.” The petitioner states that his PIL is against the violation of the rule of law, alleging that oppressive brutality is being perpetrated by the Uttar Pradesh Police. The petitioner apprised the court that he had approached Vikas Dubey in a case related to the Kanpur encounter stating that a similar incident was replicated by the Uttar Pradesh Police in the encounter of Atiq Ahmed’s son Asad.
The petitioner submitted that such incidents pose a grave threat to democracy and the rule of law, and constitute anarchy and, prima facie, development of a police-state. He also mentioned that extra-judicial killings or fake police encounters are condemned under the law and that such things cannot exist in a democratic society, adding that the police should be given ultimate justice or punishment. Can’t be allowed to become an institution. “The power of punishment is vested only in the Judiciary. When the police become ‘dare devils’ the entire rule of law collapses and creates fear in the minds of the people against the police which is very dangerous for democracy and results in also happens.” In further offence,” the petitioner said. Advocate Siyad said that on April 15, the day they were shot dead in media glare, Atiq and Ashraf were in the custody of the UP police and the onus was on them to ensure the safety of the gangster siblings. The lawyer said, however, that the assailants, disguised as media professionals, shot Atiq and Ashraf in front of police personnel. “This is a direct attack on Indian democracy and the rule of law. The attackers were subsequently arrested but during the course of the crime, there was no protection or retaliation by the police. Thus raising questions about transparency and proving the case “Premeditated attack with no redress for the accused,” advocate Vishal Tiwari said in his plea.
