SC refuses to entertain two petitions relating to Agnipath scheme

The Supreme Court on Monday declined to entertain two petitions challenging the Delhi High Court order seeking to uphold the validity of the Agneepath scheme and hold a common entrance test for the Indian Army.
A bench headed by Chief Justice DY Chandrachud declined to entertain two petitions challenging the February 27 order of the Delhi High Court. One of the petitions was filed by advocate Gopal Krishna and the other by advocate ML Sharma.
The top court said that the candidates selected in the defense recruitment process before the launch of the Agneepath scheme do not have the right of appointment.
Advocate ML Sharma sought adjournment on the ground that he had suffered brain stroke. However the court rejected his plea as it noted that Sharma’s plea stated that the Agneepath scheme was to be brought in by the Parliament and not through any scheme.
Gopal Krishna has challenged the Delhi High Court’s order dated February 27 and has also sought a direction to the authorities concerned to conduct the Common Entrance Test for the Indian Army, for which admit cards have been issued, to Indian Declare Illegally Withheld Result of Star Intake 01/2022.

Gopal Krishna, in his petition filed through advocate Arunav Mukherjee, clarified that the petitioners did not challenge the Agneepath scheme, but challenged the illegal blocking of the recruitment of those who participated in the recruitment process in 2021, several months before the announcement of the scheme. Was given June 14, 2022 with effect from June 15, 2022.
However, the top court said that before starting the Agneepath scheme, the petition related to recruitment in the Indian Air Force will be heard on April 17.
Petitioner Lokesh Kumar, represented by Advocate Prashant Bhushan, was aggrieved by the cancellation of the recruitment process by the Government and submitted, “The recruitment process was started vide notification dated 11 December 2019 issued by the Indian Air Force for the post of Airman Group “X” Trades (Except Education Instructor Trade) and Group “Y” Trades (Except Automobile Technician, Indian Air Force (Security), Indian Air Force (Police), Musician Trades).
The Delhi High Court on February 27 dismissed various petitions challenging the Centre’s Agneepath scheme seeking reinstatement and enrollment in the Indian Defense Services as per the previous recruitment scheme.
On June 14, 2022, The Union Cabinet approved a recruitment scheme for Indian youth to serve in the three services of the armed forces called Agneepath and the youth selected under the scheme will be known as Agniveers. Agneepath allows patriotic and motivated youth to serve in the armed forces for a period of four years. The Agneepath scheme is designed to enable a younger profile of the Armed Forces.
