HP High Court: Petition To Withdraw Transfer Order of Sanjay Kundu and Shalini Agnihotri Rejected
The petition seeking withdrawal of all orders related to transfer of Himachal Pradesh Director General of Police (DGP) Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri has been rejected by the Himachal Pradesh High Court. Orders to quash the petition have been issued by a division bench of Himachal Pradesh High Court Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua. Himachal Pradesh High Court, continuing its earlier orders, has issued orders to the Himachal Pradesh government to transfer both DGP Dr. Sanjay Kundu and SP Kangra Shalini Agnihotri from important posts.

Himachal Pradesh High Court Advocate General Anoop Vaidya has given complete information about the decision to Diary Times correspondent Kumud Sharma. The Himachal Pradesh High Court has left the important decision of constituting a SIT to investigate the entire matter to the Himachal Pradesh government. Himachal Pradesh government can consider constituting a SIT in the entire matter. The SIT may be constituted by the Himachal Pradesh government under the chairmanship of an IG rank police officer. Orders have been issued by the Himachal Pradesh Government to file the next status report in the Himachal Pradesh High Court on 28th February.
It is noteworthy that after obtaining interim relief from the Supreme Court of India, Himachal Pradesh DGP Dr. Sanjay Kundu had applied to withdraw the decision of the Himachal Pradesh High Court to transfer him to any other post.
Kangra District Police Administration SP Shalini Agnihotri had also filed an application to withdraw all the orders given against her. It was said in the application that she is not influencing the investigation process of the entire case in any way and she should be allowed to continue on the post of SP Kangra.
On December 26, orders were issued by the Himachal Pradesh High Court to remove Himachal Pradesh DGP Dr. Sanjay Kundu and Kangra District Police Administration SP Shalini Agnihotri from their current posts. Himachal Pradesh High Court had issued orders to the Himachal Pradesh Home Secretary to remove both the officers from important posts with immediate effect.
After that, Himachal Pradesh DGP Dr. Sanjay Kundu obtained interim relief from the Supreme Court of India and obtained a stay order on his transfers. Now the petition for cancellation of transfer of DGP Dr. Sanjay Kundu has once again been rejected by the Himachal Pradesh High Court.
The entire matter is being heard in the Himachal Pradesh High Court regarding the security of Palampur businessman Nishant Kumar Sharma and independent investigation of the entire matter.
While issuing an interim order, Himachal Pradesh High Court had already issued orders to provide proper security arrangements to Palampur businessman Nishant Kumar Sharma.
In the entire matter, Palampur businessman Nishant Kumar Sharma had also filed a petition in the Himachal Pradesh High Court to replace Kangra District Police Administration SP Shalini Agnihotri.
Palampur businessman Nishant Kumar Sharma had also made important allegations against Kangra District Police Administration SP Shalini Agnihotri of negligence in discharging all her duties in the entire matter.
On the other hand, on behalf of Himachal Pradesh DGP Dr. Sanjay Kundu, Himachal Pradesh High Court was told that his only intention to contact Palampur businessman Nishant Kumar Sharma was to mediate between the two parties and wanted to resolve the entire matter easily.
